The court did not provide immediate relief, instructing the family to share a copy with the government before the next hearing on January 4. Gupta is currently held in Prague, awaiting extradition to the US. The family’s plea, submitted by “Mr. X,” alleges Gupta’s “illegal” detention and a threat to his life as a “law-abiding citizen” and seeks the court to order India’s intervention.

The court recognized that the issue was very sensitive for the Ministry of External Affairs. Justice Sanjiv Khanna suggested that the petitioner should approach a court outside India, emphasizing that the Supreme Court of India does not have authority over arrests in another country.
